Given the number of recent media reports about the Nt teacher registration board and it’s refusal to release it’s findings into teacher disciplinary matters, it would seem this is one matter the Nt trb would also like to keep secret!
One has to ask is the Nt trb really an independent body?
Given the Nt govt has ultimate vicarious responsibility for the behaviour of it’s employees, then the Nt dept of Ed would defend allegations against it’s employees in an effort to minimise risk to the govt. Both bodies utilise the services of the Nt solicitor when making findings relating to complaints about teachers.
The Nt trb is part of the dept of Education and it’s staff are employees of that dept. It seems these staff can and do move freely between positions in all areas of the Ed
dept. Take the case of Maree Garrigan and her movements between these two organisations. How can a Director of the Nt trb leave her position and take up another position in the Dept of Ed then suddenly return to again be the Director of the trb?
Did she resign her directors position?
Did she apply for the new position in the dept of Ed?
Was it even advertised?
Are the two positions involved actual gazetted positions?
Why did she leave the position at Ed?
Was the trb directors position advertised before Maree again took up this position?
It looks very much like there is no independence between the Nt trb & the Nt dept of Ed!
There is no perception of independence and there is no real independence. The Board Chair Blanchfield has been there too long. So a limit of the tenure of a Board Chair should be in place say 4 years. As for the Director there should also be a limit of 3 years and then an option of another 3 years, so a maximum of 6 years all up. This prevents cliques. But the TRB should be seen to recruit from outside of DoE. Perhaps not having former NT teachers would be a good start. The rotten situation is just another manifestation of the rot in Darwin. No wonder retention rates in NT Government jobs are so poor. Talk about the Mafia! Even worse is the inaction of the education unions, the AEU NT and the IEU Qld & NT.

Hilton Hayes Consultancy
Please advise of the details of the Education contract awarded to Hilton Hayes Consultancy:
1. What are the terms and objectives of this project?
2. How do they plan to gather data?
3. What communities in my electorate will they visit?
4. Who will be consulted on the ground? Will interpreters be used?
5. Will Yolŋu community members be employed as part of the project?
6. How will the information be used by the Department of Education?
7. Will there be a public report and when will it made available?
RESPONSE:
1. The consultant, Mr Hylton Hayes, has advised that he is unable to continue with the contract to complete this project due to unforeseen private family matters.
The project had been commissioned by the joint school attendance taskforce* to study recent declines in enrolment and attendance in the Arnhem region and was to include analysis of both quantitative and qualitative data across 15 Arnhem schools (12 government and 3 non-government).
The objectives of this project were to:
– identify any trends and patterns in the Arnhem schools’ enrolment and attendance data
– gain community insight behind the recent declines in Arnhem schools
– provide recommendations to the taskforce to respond to the issues identified as driving the recent declines.
A copy of the intended Terms of Reference for the project is attached (Attachment A).
Due to this project being unable to be progressed as had been intended, the taskforce has been undertaking other work to achieve some of the same objectives.
This has included the establishment of a stakeholder network focused on school engagement to:
– review system-level and school-level enrolment and attendance data and identify trends
– provide community insight behind the recent declines in Arnhem schools
– collectively problem-solve new approaches to school engagement (to be undertaken in five week sprints)
– review the impact of school-level actions to improve attendance.
Participants at these forums include community members, school leaders (government and non-government) and representatives from the department, the Commonwealth Government and the Catholic Education Office.
The department is also currently developing a new terms of reference for the project and a revised scope of requirements will be prepared to reflect current needs and matters outstanding. This will include analysis of the Galiwinku and Maningrida school and community contexts as two deeper case studies. It is anticipated that this project will be a Tier 2 procurement process and normal procurement action will subsequently be undertaken.
*The joint taskforce is a Northern Territory Government and Commonwealth Government senior officials group which works to identify partnering opportunities to address attendance issues in the Northern Territory through collaborative effort. The group monitors Northern Territory enrolment and attendance data to identify trends of potential concern to enable timely and effective responses.
2. The scope of the new works is being finalized but it is likely that data analysis will be primarily conducted utilising existing datasets held by the department pertaining to enrolment and attendance, including:
– Enrolment numbers
– Attendance rates
– Reasons for non-attendance
– Student mobility
– Retention rates.
3. The scope of requirements for the revised project is being finalised but will focus on Galiwinku and Maningrida.
No communities in the Nhulunbuy electorate were visited by the Hylton Hayes Consultancy. The sites in scope for this project had been:
– Alyangula
– Alyarmandumanja Umbakumba
– Angurugu
– Baniyala Garrangali
– Gapuwiyak
– Maningrida
– Milingimbi
– Milyakburra
– Nhulunbuy
– Numbulwar
– Ramingining
– Galiwinku
– Warruwi
– Yirrkala.
The communities now participating in the stakeholder group through the taskforce are as follows:
– Alyarmandumanja Umbakumba
– Angurugu
– Baniyala Garrangali
– Gapuwiyak
– Maningrida
– Milingimbi
– Milyakburra
– Galiwinku
– Wadeye.
N.B. The stakeholder group targeted schools with an average attendance levels of less than 50%.
4. For the stakeholder group work, the community members and school leaders participating in the forums are responsible for community engagement. It is considered that through this
model of engagement that interpreters are not required.
5. Through the stakeholder group work, no additional staff members have been employed by the department. Participant community members, some of whom are Yolngu people, are committed to leading change in their communities on a voluntary basis. It should be noted that part of the work of the forums is to review whether schools are maximizing resourcing. Ideas generated through the stakeholder group may impact employment at the school level.
6. The joint taskforce will utilise findings from the school engagement forums and the new project to identify any trends and appropriate responses required at a system level, including areas for inter-government collaboration, to respond to recent declines.
7. The scope of requirements for the revised project is currently being finalised.

Can anyone explain how these people have managed to retain full teacher registration whilst not currently actually teaching in a classroom?
Can anyone imagine any of them trying to teach in a remote classroom now?
To retain teacher registration in the Northern Territory the Nt TRB requires teachers to complete at least 100 points of professional development as well as actually teach students for a minimum of 180 days in a five year period.
Some of the above have been out of classrooms for many years now, how is it they can claim a currency of practice whilst hardworking teachers actually meet these requirements as well as teach full classrooms.
Take Eva Lawler as a prime example. Maybe she is claiming her reading to children Facebook photos is evidence of practice. Maybe she claimed her unfinished government course as PD!
Eva is no longer a teacher she is just another untrustworthy politician.

You could also submit complaints to the NT TRB relating to those individual department of Education employees who covered for this person and did not act according to their responsibilities as registered teachers in the NT.
Thank you but the nt trb know all about my case and failed to do their own investigation in 2013 when I went to them initially about the other pedo at the same school and same time this convicted pedo was teaching.. maree garigan and Sharon scurr know and all they did was give a pamphlet on practical practises to this relief teacher pedo who told my year 4 daughter class rude strip search story and rude and violent comments and showed my daughter’s year 4 class faces of serial killers on death row using the school internet classroom smartboard when he was alone with the kids..at same time the other pedo teacher now convicted was molesting girls in the next classroom during recess and lunch. So much more in 2013 the trb board decided they would not look into my complaint unless I agree to reveal my name so I agreed otherwise they would refuse to discuss my complaint. Peter Chandler was at that board meeting that night how very convenient he would be there. Trb and education dep are one do not trust them at all even if new faces are there now. Icac maybe though in 2013 I had a private session with royal commission into institutionalised sexual abuse and as my case was happening at time they told me they could not intervene even though i told them the police education dep and trb were not investigating my case properly if at all. In 2015 I posted on wbnt fb a post warning parent all about convicted name suppressed who then was still teaching at that school..I got inundated with nasty comments and threatening messages including someone fake profile threatening two of my witnesses. I called police..3 days later police officer came to my house unanoun ed and handed me defamation act Peter Chandler was police minister at the time..I asked why gave you the order to come and hand me this..do they have egg on their face now threatening me with defamation when I’m speaking out about a teacher with serious misconduct with students who is now not only a convicted one but also had a previous criminal past ..it’s disgusting. Gettin so excited about this new ICAC. I see Hylton Hayes and his Government cronies all through this explanation and yes including the ex-Education Minister Eva Lawless.
Underpinning the intent of the legislation is a desire to prevent or minimise the occurrence of “improper conduct” and to improve public confidence that such conduct will be detected and dealt with. A Commissioner will be appointed who will have very broad powers to investigate, report and, if necessary, facilitate prosecutions.
Because of the very broad definitions proposed as to what might amount to “improper conduct” the legislation has the potential to impact on anyone whose activities intersect with any arm of Government.
For instance, if you contract with or use the services of any public body, or even tender for public work, the legislation will apply. If you sit on a board or committee that has or seeks public funding, you need to be aware of what activities the legislation will cover.
As currently drafted the legislation will also apply to conduct occurring even before the legislation becomes law. In other words past events can be the subject of scrutiny by ICAC.
What amounts to “improper conduct”? The legislation defines this to include:
corrupt conduct;
misconduct;
unsatisfactory conduct;
anti-democratic conduct.
Corrupt Conduct: This can include in the case of public officers, dishonesty, failing to manage conflicts of interest, breach of public trust, illegal acts in the performance of official functions, inappropriate conduct in relation to official information and conduct that effects the honest and effective performance at official functions.
However, even if you are not a public official you could be guilty of corrupt conduct if you engage in collusive tendering, provide false information, misappropriate public resources, benefit from the dishonest use of public resources or dishonestly obtain employment as a public officer.
Misconduct: This can involve conduct that would give rise to disciplinary action.
Unsatisfactory Conduct: Involved illegality, negligence and incompetence.
Anti-democratic Conduct: This is designed to target conduct surrounding elections at all levels of Government.
The ICAC will be given very broad powers to investigate. These include the power:
to require information;
inspect records;
to require a person to attend for examination;
to enter premises and execute search warrants.
Investigations can be conducted both in private and as part of a public inquiry. There is the ability to be legally represented but generally speaking you must answer all questions even if they tend to incriminate you. Confidentiality and privilege can only be claimed or maintained in very limited circumstances.
The ICAC must issue guidelines for mandatory reporting of improper conduct and can conduct reviews to determine compliance. It can issue reports as to the outcome of audits and/or the existence or otherwise of systemic issues it has identified as well as reporting on the outcome of investigations.
These reports can be made to a Minister/Government/Parliament or even made public. It can make public statements and or recommendations as to prosecution or other action.
There are significant protections in the legislation for Whistleblowers including the ability to award compensation for retaliatory action if taken against a Whistleblower.
Whilst the concept of an ICAC is new in the NT, they do exist in other jurisdictions. As an example of the nature, extent and breadth of complaints and investigations that may be expected once the ICAC is up and running, in the 2015-16 year the South Australian ICAC received a total of 1063 complaints and reports. By far the vast majority related to complaints relating to state government instrumentalities with local government the next.
The principle nature of matters investigated related to allegations of abuse of power with theft and misappropriation coming next. These figures have been increasing annually during the short life of the SA ICAC.
We encourage everyone who has an interest or concern as to what the ICAC may or can do to visit the Government website and review the legislation and avail themselves of the opportunity to raise those concerns with the new Commissioner.

We will never know.
Unless this statutory body is forced to introduce transparency to its secret investigations/findings/decisions, this public service organisation will never be seen as a ‘public service’ body.
For those concerned about the ‘Kalkarindji cattle prod’ incident, the TRB did release a report about its findings. Unfortunately that report was identified as confidental and included warnings about not releasing those findings.
The problem the general public will have with the investigation into the behaviour of Jeff Parker and his use of a cattle prod to scare a young child to leave the school, is that the NT TRB never interviewed the two dept of education employees who witnessed this incident.
That leaves one to question why the two integral witnesses were not interviewed?
One can only assume that the NT govt solicitors and the NT dept of education did not want this scandal to be properly investigated, with the vicarious liability exposed in a thorough open investigation.
So much for the TRB being a statutory body with the responsibility of ensuring Mr Parker is a fit and proper person to be registered as a teacher in the NT.
Any fair minded person would consider chasing a young child off school grounds with an electric cattle prod would cause one to question whether this person had a defect in his general character.
Surely in considering whether there was grounds to determine whether this person had a defect of character, the investigators would have examined whether other evidence of defect of character existed.
Unfortunately the secrecy involved in the investigation of these matters ensured that if such evidence exists it has not been disclosed.
In this case there were previous complaints about this person from other organisations and individuals to the NT dept of education.
Despite the existence of such evidence, the NT dept of education defended Mr Parker and claimed the teacher who reported Parker had made false & defamatory reports about Mr Parker.
Fair minded voters in the NT would naturally consider this to be a matter the new NT ICAC should investigate.
Some other evidence;
a complaint to PM Abbott’s office,
a photograph of a child taped to her desk,
a mandatory complaint relating to a child taped to a chair/desk,
a mandatory complaint relating to the cattle prod incident,
written complaints to senior staff of the dept of education,
the ‘HARRIS REPORT’,
testimony of current and former students of Kalkarindji school.
Go out to Kaljarindji and ask the community about the incident where a teacher hit a student with a rock and you will also discover that Mr Parker had a habit of throwing rocks at the teenage boys when he was angry with them.

While your there go to Dagaragu and speak to a former female student of Kalkarindji School. This young lady will happily recount an experience where Jeff Parker reacted to her behaviour in class by pressing his bunch of school keys into the back of this girls hand in an effort to stop her misbehaving in class.
You might also interview current students about how Parker would kick furniture and yell at six year old students when he lost his cool over their behaviour.

I have children going to two schools in Palmerston. I live in the electorate of Drysdale. After reading the NT News on Saturday I great concerns for children’s safety. There was a court case earlier this year. Thank goodness my youngest one was not in that school.
I was always a CLP voter and changed to Labour after the Giles lead chaos, I should have voted for the Greens.
Parents are just ignored while our children are exposed to all manner of people dressed up as teachers.
The Teacher Registration (Northern Territory) Act has to be reformed. The Board must be become independent of DoE. Who should be driving the call for such reforms? Teachers themselves and their unions.

The Teacher’s Registration Board should ensure that teachers placed in classrooms in front of children, satisfy in areas of qualification and character. The TRB should never operate on the platform of ‘near enough is good enough’ when it comes to registering teachers. Recent columns in the NT News and Sunday Territorian, suggest that the TRB has a need to much more carefully consider the worthiness of all teachers to teach. These stories and the lack of transparency are somewhat sullying of the reputation of this approving authority. Clearly, the TRB needs to take stock and look to the rebuilding of its image.

If I was a Board Member I would be nervous because the exemption from liability may not protect them if the Board has been involved dodgy activities. “I was only following advice and never actually used my brain”.
